<h3>1. About these terms</h3>
<p>This website, premiumsupps.net (the "Site"), is operated by Premium Supps ("Premium Supps", "we", "us" and "our"), a supplement brand based in Adelaide, South Australia. These Terms of Service ("Terms") apply to everyone who visits the Site or buys from us, and they incorporate our Shipping Policy, Refund Policy and Privacy Policy.</p>
<p>By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site. We may update these Terms from time to time by posting the revised version here. The version in force when you place an order applies to that order.</p>
<p>Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.</p>

<h3>2. Who can buy from us</h3>
<p>You must be at least 18 years old to purchase from the Site. By placing an order you confirm that you are 18 or over, that the information you give us is accurate, and that you are not buying on behalf of anyone under 18.</p>
<p>Products purchased from the Site are for personal use only. You may not resell our products without a written wholesale agreement with us.</p>

<h3>3. Our products and your health</h3>
<p>Our products are sports nutrition and dietary supplement products. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Information on the Site is general in nature and is not medical, nutritional or dietetic advice.</p>
<p>Always read the label and follow the directions for use. Before using any supplement, speak to your doctor or another qualified health professional, particularly if you are pregnant or breastfeeding, have a medical condition, take medication, or are under 18. Some products are not suitable for children, pregnant women or people with certain conditions; the warnings on each label apply.</p>
<p>Stop use and seek medical advice if you experience an adverse reaction. Individual results vary, and testimonials on the Site reflect individual experiences rather than typical results.</p>
<p>Formulas, ingredients and nutrition information can change between batches as we improve our products. The label on the product you receive is the authoritative source. Check it before use, especially if you have allergies or intolerances.</p>

<h3>4. Orders</h3>
<p>Placing an order through the Site is an offer to buy. Your order is accepted when we send your order confirmation, although we can still cancel an accepted order in the situations described below.</p>
<p>We may cancel or refuse an order, or limit quantities per person, household or order, where we reasonably believe an order is fraudulent, placed by a reseller, affected by a pricing or stock error, or otherwise in breach of these Terms. If we cancel an order you have paid for, we will refund you in full.</p>
<p>It is your responsibility to check your order details, including your delivery address, before checkout. See our Shipping Policy for how to request a change or cancellation.</p>

<h3>5. Pre-orders and stock</h3>
<p>Some products may be offered on pre-order or back-order. Where this applies, the product page will show the expected despatch date, which is an estimate and may change. Pre-orders are charged at checkout, and you can cancel a pre-order for a full refund at any time before it is despatched.</p>
<p>If part of your order is delayed, we may despatch the in-stock items first or contact you about your options.</p>

<h3>6. Prices and payment</h3>
<p>Prices are shown in Australian dollars and include GST where applicable, unless the checkout shows otherwise. Shipping costs are shown at checkout before you pay. Prices may change without notice, but changes will not affect orders we have already accepted.</p>
<p>Despite our care, pricing or product errors can occur. If we discover an error affecting your order, we will contact you and give you the choice of continuing at the correct price or cancelling for a full refund.</p>
<p>Payment is taken at checkout through the payment providers we make available. Your payment details are handled by those providers; we do not store your full card details. By placing an order you confirm that you are authorised to use the payment method.</p>

<h3>7. Discount codes and promotions</h3>
<p>Discount codes, free gifts and other promotions are subject to the conditions stated with the offer. Unless stated otherwise, one discount code can be used per order, codes cannot be combined, exchanged for cash or applied to past orders, and we may end or change a promotion at any time. Free gifts are subject to availability and may be substituted with an item of similar value.</p>
<p>If an order that used a promotion is returned or refunded, the value of the discount or free gift may be deducted from the refund, or we may ask you to return the gift.</p>

<h3>8. Shipping and delivery</h3>
<p>We deliver to addresses in Australia and New Zealand. Despatch times, shipping costs and what to do if a parcel is late, missing or damaged are set out in our Shipping Policy, which forms part of these Terms.</p>
<p>Ownership of the products passes to you when we receive full payment. Risk in the products passes to you when they are delivered to the address you gave us, or to any safe-drop location or collection point you nominate or the carrier uses on your instructions.</p>

<h3>9. Returns, refunds and consumer guarantees</h3>
<p>Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.</p>
<p>New Zealand customers have equivalent rights under the Consumer Guarantees Act 1993 (NZ).</p>
<p>How to return a product, including our 30-day change-of-mind returns, is set out in our Refund Policy, which forms part of these Terms.</p>

<h3>10. Marketing communications</h3>
<p>If you opt in to marketing at checkout, sign up to our newsletter or enter a promotion, we may send you marketing emails and, where you have given us your mobile number and opted in, marketing text messages. Consent to marketing is never a condition of purchase.</p>
<p>You can unsubscribe at any time using the link in any marketing email or by replying STOP to any marketing text message. Standard carrier charges may apply to text messages. We will still send you transactional messages about your orders. See our Privacy Policy for how we handle your information.</p>

<h3>11. Reviews and other content you submit</h3>
<p>We welcome honest reviews, photos, comments and other content you submit to the Site or share with us, including on third-party review platforms and social media where you tag us ("Your Content"). You keep ownership of Your Content, but you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit for length and display Your Content on the Site, in our marketing and on social media.</p>
<p>You confirm that Your Content is your own honest opinion or experience, does not infringe anyone else's rights, and does not contain unlawful, offensive or misleading material. We may remove content that breaches these Terms, but we do not remove genuine reviews because they are negative.</p>
<p>Where we offer an incentive for leaving a review, it is offered for any honest review, positive or negative, and this is disclosed where the incentive is offered.</p>

<h3>12. Intellectual property</h3>
<p>The Site and everything on it, including the Premium Supps name and logo, product names, formulas, images, text, designs and software, are owned by or licensed to us and are protected by Australian and international intellectual property laws. You may view and print pages for your personal use, but you may not copy, modify, distribute, sell or otherwise exploit any part of the Site or our branding without our written permission.</p>

<h3>13. Acceptable use</h3>
<p>You must not use the Site for any unlawful purpose; to place fraudulent orders or use payment methods you are not authorised to use; to submit false or misleading information; to infringe our or anyone else's intellectual property; to upload malicious code, scrape, crawl or interfere with the security or operation of the Site; to harass or abuse anyone; or to collect other users' personal information. We may suspend or block your access, and cancel your orders, if you breach these Terms.</p>

<h3>14. Third-party links and tools</h3>
<p>The Site may contain links to, or tools provided by, third parties, such as payment providers, review platforms, delivery tracking and social media. We do not control those third parties and are not responsible for their content, services or privacy practices. Your dealings with them are governed by their own terms.</p>

<h3>15. Information on the Site</h3>
<p>We work hard to keep the Site accurate and up to date, but information may occasionally contain errors or be out of date, including product descriptions, images, pricing, stock and delivery estimates. We may correct errors and update or remove content at any time. Product images are for illustration; packaging and colours may vary.</p>

<h3>16. Liability</h3>
<p>Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, the Consumer Guarantees Act 1993 (NZ) or any other law that cannot be excluded.</p>
<p>To the maximum extent permitted by law, and subject to those non-excludable rights, we are not liable for any indirect or consequential loss (such as loss of profits, business or opportunity) arising from your use of the Site or our products, and our total liability to you in connection with an order is limited to the amount you paid for that order.</p>
<p>To the extent permitted by law, we are not responsible for loss or injury that results from using a product other than in accordance with its label directions and warnings.</p>

<h3>17. Indemnity</h3>
<p>To the extent permitted by law, you agree to indemnify us against loss, damage, costs and claims arising from your breach of these Terms or your unlawful use of the Site or our products, except to the extent we caused the loss.</p>

<h3>18. Wholesale and resale</h3>
<p>These Terms cover retail purchases. Wholesale customers, gyms and retailers buy under separate terms. Email admin@premiumsupps.net if you are interested in stocking Premium Supps.</p>

<h3>19. General</h3>
<p><strong>Governing law.</strong> These Terms are governed by the laws of South Australia, Australia, and you agree to the non-exclusive jurisdiction of the courts of South Australia. This does not affect any rights New Zealand customers have under New Zealand consumer law.</p>
<p><strong>Severability.</strong> If any part of these Terms is unenforceable, the rest continues to apply.</p>
<p><strong>No waiver.</strong> If we do not enforce a term, that is not a waiver of it.</p>
<p><strong>Entire agreement.</strong> These Terms, together with our Shipping, Refund and Privacy Policies and your order confirmation, are the whole agreement between you and us for your purchase.</p>
<p><strong>Termination.</strong> We may end or suspend your access to the Site at any time if you breach these Terms. Sections that by their nature should survive, including intellectual property, liability and indemnity, continue after termination.</p>
